1. Purpose and Scope
This Acceptable Use Policy ("AUP") explains what is and is not allowed on the websites, hosting, email, domain and other services of Foxeep, Inc. ("Foxeep"). It is part of our Terms of Service and applies to every customer, reseller end user and visitor who uses our Services.
We designed this policy to protect our customers, our network and the public, and to comply with U.S. federal law, the laws of the State of Delaware, and the rules of our payment processors (bank card processors and PayPal) and card networks.
2. Illegal Activity
- Any activity that violates applicable federal, state, local or international law or regulation.
- Fraud, phishing, identity theft, money laundering, pyramid or Ponzi schemes, and deceptive or unfair business practices under the FTC Act and the Delaware Consumer Fraud Act.
- Sale or promotion of illegal drugs, weapons prohibited by law, counterfeit goods, stolen data or payment card information.
- Unlicensed gambling, and any business prohibited by our payment processors' restricted business lists.
- Activity involving persons or countries subject to U.S. sanctions administered by OFAC or export controls under the EAR.
3. Prohibited Content
- Child sexual abuse material. We report it to the National Center for Missing & Exploited Children as required by 18 U.S.C. § 2258A and cooperate fully with law enforcement.
- Non-consensual intimate imagery, content that promotes terrorism, or content that incites violence against people or groups.
- Content that infringes copyrights, trademarks or other intellectual property rights (see our DMCA Policy).
- Defamation, harassment, threats, doxxing, or content that violates the privacy or publicity rights of others.
4. Email and Spam
- Sending unsolicited bulk or commercial email, or any email that violates the CAN-SPAM Act (15 U.S.C. § 7701 et seq.).
- Using purchased, rented or scraped email lists, or hiding the sender's identity.
- Operating open mail relays or proxies, or advertising a website hosted with us through spam sent from anywhere.
- Shared hosting accounts may send up to 300 emails per hour. Larger mailings require a dedicated email marketing service.
5. Network and Security Abuse
- Distributing malware, viruses, ransomware or exploit kits, or hosting phishing pages or command-and-control servers.
- Port scanning, brute-force attacks, denial-of-service attacks or attempts to access systems without authorization (Computer Fraud and Abuse Act, 18 U.S.C. § 1030).
- Bypassing account limits, security controls or authentication, or interfering with other customers' services.
6. Fair Use of Resources
Shared hosting servers are used by many customers. Accounts must stay within the CPU, memory, process, inode and storage limits of their plan. "Unmetered" bandwidth means we do not charge for data transfer used by normal websites; it does not mean unlimited resources.
- Not allowed on shared plans: cryptocurrency mining, public proxies or VPNs, game servers, torrent trackers, file-sharing or backup storage unrelated to a website, and media streaming services.
- If an account harms server performance, we may temporarily limit it and will contact you to find a solution, such as optimizing the site or upgrading the plan.
7. Reseller Responsibilities
Resellers are responsible for their end users' compliance with this AUP and must require their customers to accept terms at least as strict as this policy.
8. Enforcement
We may investigate suspected violations, remove content, suspend or terminate Services, and cooperate with law enforcement. Whenever reasonable and lawful, we notify you first and give you time to fix the problem. We act immediately without notice when there is a security threat, legal risk or harm to others. Accounts terminated for serious or repeated AUP violations are not eligible for refunds, except where required by law.
9. Reporting Violations
Report abuse to abuse@foxeep.com with the URL, email headers or other evidence. Copyright complaints follow our DMCA Policy. Security vulnerabilities in our own systems can be reported to security@foxeep.com.
These policies and agreements may be changed at any time when necessary. The current version is always published on this page with the date of its last update.
